• WORKSHOPS, SEMINARS & EVENTS, EXHIBITIONS, CROWDFUNDING, INSTAGRAM SCOUTING, BOOK PUBLISHING, HASHTAG LAUNCHING, PROJECTS COUCHING, PROMOTIONS, CONTESTS, PRINT ON-DEMAND, E-COMMERCE, AWARDS LAUNCHING.

• PUBLIC EVENTS.

• LINKS TO GRANTS, FELLOWSHIPS, RESIDENCIES, SCHOLARSHIPS, AWARDS AND COMPETITION LISTINGS.

 

4. CONTENT

You are solely responsible for any data, text, software, music sound, images, photographs, graphics, video, messages, files or other materials ("Content") which is transmitted, posted, or distributed by you through 1415photographers.com and its social channels and its publishing projects (suche as books, zines, notebooks and other supports), including but not limited to the contents of your e-mail communications, information, photos or images posted by you or posted to your Profile Page and information, photos, images, sound files or other Content posted by you in a forum or other page. By sending or posting Content you warrant and represent that you own all right, title and interest to that Content and any likenesses contained in that Content. You agree to not send or post anything to which you do not have the rights. 1415photographers.com and its social channels do not own or control the Content posted by Users via the Service and, does not guarantee the accuracy, integrity or quality of such Content. You may be exposed to Content posted by other Users that may be offensive, indecent or objectionable. Under no circumstances will 1415photographers.com or its social channels be liable in any way for any Content published in books or posted by any User or third party, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed or otherwise transmitted via the Service.

4.1 EDITORIAL AND PUBLISHING PROJECTS

Participation in publishing projects is spontaneous and occurs through registration on the websites 1415photographers.com. Participation in publishing projects respects the same rules and premises already expressed in these Terms and Conditions, about copyright, rights of publication and privacy of the subjects. All registered Participants are solely responsible for the pictures submitted or tagged for a publishing project under their name or nickname.1415photographers.com is not responsible in any way and in any case for any subject, logo, place, structure, person, animal and in general for any element included with/in the image submitted by the User/Participant. Furthermore 1415photographers.com and its social channels are not responsible in any way for the use of the post-processing and/or posting/sharing software or app done by any User. Any User/Participant is solely responsible for the content of images and texts submitted and the information contained therein or in any way related to it. All Participants own the rights of their pictures and content submitted for a publishing project, as expressed in chapter 5.2 of general Terms & Conditions, and 1415photographers.com and its owner will never assume the ownship of content submitted by any participant.

Users who participate in the collective publishing projects of 1415photographers.com do it for free, whitout expecting or demanding any fee or economic compensation in return. Users who participate in collective publishing and editorial projects by 1415photographers.com give to 1415photographers.com and its owner the right to publish and commercialize the book, containing their images , for a limited time of 20 years, either directly by 1415photographers.com through online and web sales or through bookshops, and also through distributors or other publishers in partnership with 1415photographers.com all over the world. In exchange 1415photographers.com will guarantee to every registered and published author a considerable discount, on the cover price of the book belonging to the publishing project in which the author has participated, unless otherwise stated. Discount can used by a published author until the book runs out of copies.

 

5. USER'S GRANT OF LIMITED LICENSE

5.1. 1415photographers.com and its social channels do not claim any permanent ownership of Content you submit or make available for inclusion on the Service. However, in the modern age of content hosting and the propagation and streaming of content across the web, we require a limited license to host and display this content, as specified below, which lasts as long as you chose to host your work on the service. For example, one purpose for this limited license is to enable 1415photographers.com to stream and present your work across its network and partner sites that present your work professionally - linking back to your portfolio. We require a limited license for your content in order to present it in the many places and various forms across the 1415photographers.com social channels. The limited license below is required to allow 1415photographers.com to host, display, organize, promote and propagate your portfolio of projects or single pictures. By communicating with 1415photographers.com and its social channels, including submitting or sending Content, correspondence or other information or material to 1415photographers.com  ("Your Content"), you grant 1415photographers.com a limited license for the period of time your Content is published in 1415photographers.com  systems, to display the work royalty-free, unrestricted, and world-wide, across 1415photographers.com and its social channels, in search results, and in 1415photographers.com powered Projects, Categories and Features. In some instances, media must be reformatted for display and incorporation into 1415photographers.com galleries. As such, during this limited license, you allow 1415photographers.com to reproduce, modify, publish, translate, distribute, perform and display your Content (in whole or part), and/or to incorporate it in other works in any form, media, or technology now known or later developed. Such limited license also includes incorporating Content, in whole or in part, into a 1415photographers.com feature or in promotional or marketing materials (attributed properly to the artist).

5.2. 1415photographers.com will NEVER assume ownership of your work, and the artist's copyright settings, as selected by the artist, will remain associated with each published project. The artist will always keep the property of the copyrights of the images, text and any kind of Content, of which the artist is the author or owns the copyrights or property, published, distributed, conveyed, shown or sold by 1415photographers.com through its webiste and social channel. This limited license is required for the nature of 1415photographers.com website. Work submitted to 1415photographers.com website remains owned by the artist, under the artist's selected copyright settings, and artists decide whether or not to sell their work to third parties, unless the artist has given the official consent and agrees to participate in specific projects, which contain specific clauses on the subject. - 1415photographers.com will act as an intermediary in selling creative work only under artists authorization, such as for example sales of fine art prints, postcards, books, gadget materials and more. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of your Content. You acknowledge and agree that the display or inclusion of your Content shall be in the sole discretion of 1415photographers.com and your Content may or may not be included on the 14&15 Srl's websites for any reason or no reason at all.

BY UPLOADING CONTENT TO 14&15 Srl's WEBSITES YOU AGREE NOT TO VIOLATE ANY LAW, REGULATION OR AGREEMENT WITH RESPECT TO ANY INTELLECTUAL PROPERTY RIGHT WHICH MAY APPLY, AND YOU FURTHER AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS, 14&15 Srl, IT'S OWNERS, AGENTS, OFFICERS, DIRECTORS AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS ALLEGING VIOLATION OF ANY INTELLECTUAL PROPERTY RIGHT ASSOCIATED WITH YOUR USE OF THE WEBSITE.

 

6. USER CONDUCT

You acknowledge and agree:

6.2. without limitation of the foregoing, not to use the websites or Services to submit any Content regarding any products or multimedia files, or make comments about them, that are unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, libelous, deceptive, fraudulent, contains explicit or graphic descriptions or accounts of sexual acts, invasive of another’s privacy, or hateful; or that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.

6.3. that 14&15 Srl is not responsible for material submitted to 1415photographers.com and its social channels or posted to the websites by Users. 14&15 Srl does not pre-screen, monitor, review or edit the Content posted by Users. However, 1415photographers.com and its designees have the right (but not the obligation) at their sole discretion to refuse or remove any Content, in whole or part, that in 1415photographers.com judgment does not comply with these Terms and Conditions or is otherwise undesirable, inappropriate or inaccurate. 1415photographers.com is not responsible for any failure, non-failure or delay in removing such Content. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such submitted material, including any Content or part thereof, or other communication to 14&15 Srl. You agree to immediately notify 1415photographers.com of any unauthorized use of the Service or any other breach of security that you know or suspect.

 

7. PAYMENTS

7.1. A valid paypal account or credit card is required for paying subscriptions. This is not required to create or use a free account, or to use the websites.

7.2. The Service is billed in advance. There will be no refunds or credits for partial use of service, upgrade/downgrade refunds, or refunds for service unused. All the incoming or outgoing payments done with paypal service are charged by paypal following theis fees transaction. 1415photographers.com and its owner is not responsible in any way for the transaction fees charged by Paypal or Visa or anyother financial company used by User or by 1415photographers.com for purchasing products, royalies payments, money refunds , general payment or money transfer done with or through 1415photographers.com. Refer to such companies for any complaint.

7.3. If your subscription charge is denied, we will not attempt to re-charge your PayPal account or Credit Card and your subscription will be deleted or not confirmed.

7.4. All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.

 

8. CANCELLATION AND TERMINATION

You are solely responsible for properly canceling your subscription. You can cancel your subscription to 1415photographers.com by emailing us your unscribing decision.

You can cancel at any time, but you will remain liable for all charges accrued up to that time, including full charges for the period which you discontinued service. You will not be charged again.

1415photographers.com reserves the right to modify, suspend, or terminate your account at any time for any reason without notice or refund. We reserve the right to delete all Content associated with your account.

 

9. MODIFICATIONS TO SERVICE

1415photographers.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that 1415photographers.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

14.3 We operate the Websites from our office in Rome, Italy. Persons who choose to access 1415photographers.com from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

 

15. MISCELLANEOUS

If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Nothing in these Terms and Conditions shall be deemed to create any rights for any third party beneficiary. The section titles in these Terms and Conditions are for convenience only, and have no legal or contractual effect. 16. COLLECTIVE EDITORIAL AND PUBLISHING PROJECTS

All users who thake part in one or more of 14&15 srl's individual or collective publications, editorial projects, projects in general and/or any other publication activities guarantees to be the holder of any and all exclusive rights of exploitation of the submitted and published materials, to have free availability and to have the faculty and capabilities necessary to enter into this Terms & Conditions; in the same way, the author, acting for himself, his heirs and having any right, with the acceptance of the Terms & Conditions, gives exclusively to 1415photographers.com, for a period of ten years, all the rights necessary to proceed with the print and publication of his submitted work (pictures, texts) in a book and for the consequent marketing of  ithe volumes in any form; unless explicit agreements with the Publisher, the authors who are part of collective projects, launched and/or supported and/or organized by 1415photographers.com, individually or in agreement with third parties, and who have authorized 1415photographers.com to publish their images on printed volumes and/or photographic prints will not receive any earnings or financial compensation for all the images used or published by the Publisher.

The Publisher has the faculty to reprint each edition as many times as he wants, to set a cover price and a print run for each edition of the volume, without the need to find a previous agreement with the author.

The phrase "Collective Editorial and Publishing Projects" refers to all those projects that make use of the photographic and textual contribution of several people who, through the launch of a specific theme and hashtag in the social networks and media, participate in the project through consensual registration, carried out on one or more of the websites of 1415photographers.com, making available their images and texts, produced specifically for the related projects or already produced before the projects themself. The purpose of the "collective editorial and publishing projects" is of editorial type and therefore printed books, photographic exhibitions, projections of images and, more in general, the printing, the publication, the projection or the vision of images and texts on any kind of support and in all those situations envisaged by the projects themselves.

16.1 GENERAL CONDITIONS

For practical reasons we will use the term "Collective Projects" to define "Collective Editorial and Publishing Projects".

The general conditions of participation and / or use of the Collective Projects  are related to the general terms and conditions contained in these Terms and Conditions, as mentioned from chapters 1 to 15 and chapters 17 and 19, except for some general rules specifically related to Collective Projects, as follows:

16.1.1 Users who have not partecipated in the Collective Projects and have not registered, as reported in the Collective Projects rules in 1415photographers.com  and in Instagram feeds @1415mobilephotographers, and have not correctly provided all the requested info, are not admitted to partecipate in the Collective Projects (challenges and books included).

16.1.2 All selected registered participants for Collective Projects agree to give to 1415photographers.com a limited license to allow 1415photographers.com to host, display, organize, print, promote, share and propagate your picture through 1415photographers.com, social channels, web channels, newsletter, e-mail, and through any approrpiate sharing and promotional channels. Furthermore all selected registered participants allow 1415photographers.com, during this limited licence, to reproduce, modify, publish, translate, distribute, perform and display your Content (in whole or part), and/or to incorporate it in other works in any form, media, or technology now known or later developed. Such limited license also includes incorporating Content, in whole or in part, into a 1415photographers.com feature or in promotional or marketing materials (attributed properly to the artist). For the general User's Grant Of Limited Licence read chaper 5 in the general Terms & Conditions of this website.

16.2 GENERAL RULES

General rules and requirements to be admitted to partecipate to the Collective Projects (challenges and books) are the following.

16.2.1 All Users must follow the Collective Projects rules and register to the Collective Projects specific registration pages on 1415photographers.com, providing valid contact details.

16.2.2 All registered Participants are solely responsible for the pictures submitted or tagged for the Collective Projects under their name or nickname. 1415photographers.com is not responsible in any way and in any case for any subject, logo, place, structure, person, animal and in general for any element included with/in the image submitted by the User/Participant. Furthermore 1415photographers.com and its websites are not responsible in any way for the use of the post-processing and/or posting/sharing software or app done by any User. Any User/Participant is solely responsible for the content of images submitted to the Collective Projects and the information contained therein or in any way related to it. For the general guarantees that bind the User/Participant to the Collective Projects through the use of the 1415photographers.com web sites or its social accounts, read general Terms & Conditions of this website.

16.3 COPYRIGHTS

All Participants own the rights of their pictures and content submitted for the Collective Projects, as expressed in chapter 5.2 of general Terms & Conditions, and 1415photographers.com will never assume the ownship of content submitted by any participant.

17. TREATMENT OF PERSONAL DATA

If a user completes any kind of registration or submission process, filling any of the forms published in 1415photographers.com, he automatically authorizes the treatment of his personal data, declaring to be aware of legal rights recognized in conformity with the Italian Law n.196/2003 regarding the safeguarding of privacy and with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the European Parliament and Council Directive (EU) 2016/680 of 27 April 2016 on the protection of individuals with regard to the processing of personal data by the competent authorities for the purpose of the prevention, investigation, detection and prosecution of criminal offenses or enforcement of criminal sanctions and the free movement of such data.

18. BOW AWARD COLLECTION and SELECTION

All the printed books that are part of the BOW Award collection and that have been sent as a prize to the winners of the weekly Best Of The Week, will be put on our online store as "out of stock"and will be activated in the event of a purchase request by a third party or a printed request by the author. Each book in this collection that will be sold directly or placed in presale will yield a gain of € 2 per sold copy to the author.

18.1 BOW AWARD CONTEST

All participants in the contest must register to 1415photographers.com. With the registration each user or participant gives to 1415photographers.com the permanent right to print and publish his selected pictures on the monthly publication Best Of The Week Selection; by registering for the Best Of The Week contest through 1415photographers.com, every author or user authorizes permanently 1415photographers.com to print their submitted images, for all those publications related to the BOW contest. To recede from these Terms & Conditions a specific e-mail addressed to 1415photographers.com is required.

19. DISPUTES

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state courts of Rome, Italy.
